As detailed further below, each of the plaintiffs has an actual or perceived mental disability and was unlawfully seized and forced into unconstitutional confinement during interactions with police.\n\n- On August 25, 2019, plaintiff Justin Baerga was home with his mother experiencing a mental health crisis when his mother called 911 requesting an ambulance. Armed NYPD officers arrived instead, forcibly entered Baerga's home, strapped him to a gurney, and transported him to a hospital against his will. \n\n- On May 6, 2020, plaintiff Steven Greene was home when armed police officers and NYC EMS personnel arrived, claiming that he was suicidal. Even though plaintiff clearly and calmly explained that he was not suicidal, the police officers forcibly detained him and transported him to a hospital against his will.\n\n- On November 7, 2020, plaintiff Giovanna Sanchez-Esquivel was home when her boyfriend called 911, stating that she was having a manic episode. Plaintiff was not violent and remained calm throughout the entire interaction, yet NYPD officers forcibly detained her and committed her to a hospital against her will.\n\n- On March 13, 2020, plaintiff Sarah Arvio was on the phone with her doctor's office regarding a liver ailment when she said in frustration \"I'm so frustrated with you all that I feel like jumping off the bridge.\" Minutes later, armed NYPD officers and EMS personnel forcibly detained plaintiff and involuntarily committed her to a hospital.","incident_location":"At residence but not inside (i.e. Lobby/stairwell/yard/etc), Inside residence","allegations":["ADA or other disability claim","Excessive force/assault and battery","False arrest/False imprisonment","Unlawful stop and/or search"],"types_force":["Non-weapon physical force","Tight handcuffs"],"defendant_types":["NYPD"],"documents":[{"url":"https://storage.courtlistener.com/recap/gov.uscourts.nysd.562855/gov.uscourts.nysd.562855.21.0.pdf","type":"complaint"}],"payout_amount":0,"url":"https://www.courtlistener.com/docket/60036947/baerga-v-city-of-new-york/"},{"name":"Johnson, Deandre vs City of New York, et al.","start_date":"2015-08-31","disposition_date":"2018-04-16","payout_amount":7500,"disposition":"Settlement","docket":"157655/2015","court":"Supreme Court - New York","officer_name":"Mole, Nathan ","summary":"On February 27, 2013, Plaintiff was unlawfully stopped, frisked, searched, and falsely arrested/imprisoned by Defendants Police Officers Joseph Morovich, Matthew McCarthy, and John Does #1-10. Defendant Police Officers refused to tell Plaintiff why he was stopped, then took him to the 25th precinct. There, he was strip searched in a filthy bathroom, including having to spread his buttocks and lift his genitals. At no time was any contraband present, and Plaintiff was severely traumatized and emasculated by the unlawful strip search. Plaintiff was then detained in a holding cell for aproximately 4 hours as Defendant Police Officers provided false and misleading information to the District Attorney's office, initiating a criminal prosecution. \n\nOn April 16, 2013, Plaintiff was wrongfully and unlawfully charged with Unlawful Possession of Marijuana as a result of the fabricated allegations, and had to attend approximately 7 subsequent court appearances.","documents":[{"url":"https://iapps.courts.state.ny.us/nyscef/DocumentList?docketId=/WbwsAxPr4JCaR4HMFUPkQ==&display=all&courtType=New%20York%20County%20Supreme%20Court&resultsPageNum=1","type":"complaint"}]},{"name":"Garcia, Oscar, et al. vs City of New York, et al.","start_date":"2014-07-21","disposition_date":"2016-03-31","payout_amount":0,"disposition":"Zero Disposition","docket":"14CV04160","court":"U.S. District Court - Eastern District NY","officer_name":"Mole, Nathan ","summary":"On August 20, 2011 at 12:40AM, Plaintiffs were lawfully inside of their place of business when an argument erupted with someone who entered the business (who is listed as a defendant in the case). As a result of this argument, the police (Police Officers Michael Demonda, Louis Stephenson, Nicole Perl and Sgt. Nathan Mole and unknown officers) arrived at the business, and without investigation or hesitation, started to attack, assault and arrest the plaintiffs. NYPD officers beat the plaintiffs without justification or cause. Once arrested and transported to the precinct, officers ridiculed the plaintiffs with foul and racist language.
