POs Livingston, Lopez, Altilio and John/Jane Does 1-10 were at the building investigating a call from a complaining resident. They knocked on the door to plaintiff's residence, without probable cause or justification and without a warrant. Plaintiff opened the door and then the officers told her they were there to ask her questions. The officers entered under false pretenses, and as plaintiff got dressed, they conducted an illegal search of her residence. PO Livingston seized an empty packaging box with the name of another individual, and began to illegally question plaintiff about the box. Livingston accused plaintiff of a criminal offense, without probable cause. The officers then seized plaintiff, violently contorting her arms behind her back so they could apply metal handcuffs, disregarding her complaints that the cuffs were too tight and ignoring her requests to loosen them. The officers then illegally searched her person and continue to search her residence. The officers seized an Apple iPad, and without further investigation as to when it was purchased, assumed it was stolen property. They took plaintiff to the precinct. Plaintiff complained of her medical condition that made her prone to seizures, and she was taken to hospital to receive seizure medication. She was then taken back to the precinct, where she was fingerprinted, photographed, searched or strip-searched, and confined to a dank and dirty cell for ~21 hours. Defendants swore false allegations accusing plaintiff of larceny. Defendants' actions were retaliation for plaintiff expressing her displeasure at the way the officers addressed her, and her polite request for an explanation as to why they were so discourteous toward her.
