Ms. Davis was admitted to Long Island Jewish Hospital in Queens and was diagnosed with bipolar disorder and depression. Ms. Davis was 17 years old at the time and the primary caretaker for her mother and 9-year-old brother. The three lived in a duplex above Ms. Davis' Uncle, Mr. Shawn Davis. Ms. Davis and Mr. Davis had a strained relationship.\n\nOn May 1, 2017, Ms. Davis and Mr. Davis got into an argument about finances. Mr. Davis called the police. The responding NYPD Officers credited Mr. Davis' account of what happened and not Ms. Davis' account. Mr. Davis informed the Officers that Ms. Davis was diagnosed with bipolar disorder and depression. Mr. Davis spit in Ms. Davis' face and the Officers did nothing. The Officers handcuffed Ms. Davis and put her in a police car, taking care to hit her shin with the car door in the process. The NYPD Officers made no effort to accommodate Ms. Davis' disability when they interacted with her. On May 2, 2017, Ms. Davis was arraigned. The judge issued a temporary order of protection ordering Ms. Davis and Mr. Davis to stay away from each other, but permitted incidental contact at the home.\n\nOn June 20, 2017, Officer Grubert was conducting a home check and arrested Ms. Davis for violating the order of protection even though she was allowed to be in her home. On June 21, 2017, Ms. Davis was arraigned. The judge again issued at order of protection that allowed Ms. Davis to return home. On July 13, 2017, Ms. Davis was inside her home when Mr. Davis began threatening her and her brother from outside the home. Ms. Davis called the police. The responding NYPD Officers proceeded to arrest Ms. Davis for violating the order of protection even though she was permitted to be in her home. At her July 14, 2017, arraignment, the judge ordered no contact between Ms. and Mr. Davis, rendering Ms. Davis homeless. On August 6, 2017, Ms. Davis was again arrested for violating the order of protection even though she did not go to her home.
