When defendant officers stopped and frisked plaintiff and obtained no contraband, instead of releasing plaintiff, plaintiff was cuffed and detained to search for evidence of a crime.  \n\nPlaintiff was then falsely charged by defendant officer Weck of Disorderly Conduct, for running towards plaintiff in a violent manner when body camera footage shows that plaintiff stood completely still with his hands in the air as officers approached him. \n\nThe District Attorney's office declined to prosecute the bogus charge. \n\nOn June 5, 2021, defendant officers of the 40th Precinct including but not limited to defendant officers Hijazi and Juciano pulled over Plaintiff, asked him to step out of his vehicle, and arrested him. Defendant Sgt. Santos responded to the scene and did nothing to prevent the unlawful arrest or detention of Plaintiff. The officers did not look up Plaintiff’s driving record for at least two hours after the\narrest, at which time they used the information to charge Plaintiff with a traffic infraction without conducting any testing on the substance found in the vehicle to\nconfirm its contents, and maliciously charged Plaintiff without probable cause that the substance was, in fact, unlawful. Defendants held Plaintiff for over 24 hours before sending him to arraignment for the improper purpose of gathering evidence to cover up the unlawful stop.\nAll charges arising from this unlawful stop were dismissed in their entirety on the\nnearly two months later, on July 29, 2023. \n\nOn November 11, 2022, Does 1 and 2, both described as\nHispanic males, came to Plaintiff’s Bronx home, entered his bedroom while\nhe was asleep, shined their flashlights in his eyes, and claimed to have a warrant for his arrest. No such warrant ever existed.  At some point, Plaintiff learned that he was suspected of participating in a robbery. But after some time, Plaintiff was told that the case against him was “dismissed.” The Doe Defendants held Plaintiff for an additional 1–2 hours, again without probable cause, claiming that that there was a second warrant that needed to be “cleared” before Plaintiff could leave. Again, no such warrant ever existed. When the Doe Officers found nothing, they let Plaintiff go without any ticket, summons, or other paperwork, and Plaintiff never heard anything of the supposed warrants or potential charges again.","documents":[{"url":"https://iapps.courts.state.ny.us/nyscef/ViewDocument?docIndex=_PLUS_Quw2bFJy4Pbh7AcAnhU7w==","type":"complaint"}]},{"name":"Daniels, Dante vs City of Ny, et al.","start_date":"2022-07-05","disposition_date":"2025-12-03","payout_amount":100000,"disposition":"Settlement","docket":"808766/2022E","court":"Supreme Court - Bronx","summary":"On August 13, 2021, at approximately 11:30 p.m., the plaintiff, was lawfully in the vicinity of the Forest Housing Project, when defendant PO Miglaccio, Amarantepolanco and Liriano and others were conducting an arrest of a person by the name of \"Shawn\" where many of the individuals present at the location were objecting to the excessive use of force by the defendants on Shawn , which resulted in the use of pepper spray/mace on a number of individuals present. \n The defendant officers violently grabbed the plaintiff, threw him to the ground and jumped on him by several defendants. The officers then struck plaintiff in the head, body and limbs, causing injury. Officers placed their knees on the plaintiff's body and ground the plaintiff's face and body into the street. PO defendants handcuffed the plaintiff, and bent his body in half, attempting to bring his feet towards the back of his head. Plaintiff was unlawfully arrested and taken to the 42nd Precinct in his underpants since his pants having fallen down his body during the assault, causing him further embarrassment. Plaintiff was thereafter transported to PSA-7 where he fell sick to the floor inside a holding cell. As a result of the defendant’s assault, plaintiff fell ill and was transported from the precinct to the Bronx Lebanon Hospital ER where he was treated and released and then transported back to PSA-7 shackles handcuffed. While plaintiff was in the custody of the defendants, defendants prepared and filed false paperwork against plaintiff. At plaintiff’s arraignment, the judge imposed $75,000 bail based on the officer’s false paperwork, which plaintiff could not afford. As a result, the plaintiff was unlawfully imprisoned until approximately August 17, 2021.
