Then, NYPD officers Vincent Mugno, Joseph C. Digennaro, William Wanamaker, William Parker, and Frank Caruso, supervised by officers Michael Coyle and Neal Polis, and dressed in black military-type gear and wearing helmets with face shields, smashed in the door of the premises and ran into it, brandishing pistols, ballistic shields, rifles, and flashlights. Two of the officers ran into the bedroom where Plaintiff 1 was sitting on his bed reading, jumped onto the bed, ordered Plaintiff 1 to kneel on the floor, which he did, pulled his hands behind his back and handcuffed him. With absolutely no cause to do so whatsoever, one or more of the officers struck Plaintiff 1 with a rifle butt and with a ballistic shield, thereby causing a severely bleeding laceration to his head. During these events, officers, inter alia, asked Plaintiff 1 repeatedly to show where the \"pot\" was. He was told by one of the officers that if he wanted his wife and his mother-in-law to be able to sleep in their own beds that night, he would tell the officers where the \"pot\" was. There was no marijuana in the subject premises. Plaintiff 1’s wife and his mother-in-law were arrested and taken to the precinct. Plaintiff 1 was taken by ambulance to a hospital, where his scalp wound was treated with three staples and six sutures. The following day, he too was brought to the precinct. \n\nOn the night of the aforementioned incursion, Plaintiff 2, having been told by a friend that his parents' house had been raided by a SWAT team, went to the precinct to inquire as to what had happened. There, he was questioned, thrown against a wall, and placed under arrest. All four were then transported to Central Booking and were later brought before a judge. The destructive search of the subject premises yielded medication that Plaintiff 1’s wife had been prescribed for back ailments, untaxed cigarettes that had been provided to plaintiffs by a friend who was employed by EI-AI Airlines, an old air rifle that Plaintiff 1 had purchased for Plaintiff 2 fifteen years previously, and a knife in a box. PO Mugno charged both plaintiffs with several crimes/offenses related to the discovered items. PO Mugno also took a substantial amount of currency that Plaintiff 1 and his wife had put aside to pay for the wedding of their other son.
