The vagrant swung bolt cutters at Plaintiff, who blocked it with the vagrant's bag of burglary tools. Plaintiff then ran to the nearby 77th Precinct and informed POs. POs instructed him to return home and call 911. After Plaintiff protested, POs, including PO Deidre Defreitas who had been the subject of previous complaints, accompanied Plaintiff back to his residence and observed the damaged door and security system. As they were investigating, the vagrant reappeared and was detained. Lt. John Sellitti, who had been the subject of previous complaints, arrived but refused to investigate the damage and instead spoke with the vagrant. Together, Lt. Sellitti and the vagrant concocted a story that Plaintiff had injured the vagrant and Plaintiff was arrested, despite the fact that Plaintiff was recovering from hand surgery and was in fact on his way to a medical appointment regarding it. Plaintiff provided document and physical proof of his surgery. \n\nNevertheless, Lt. Sellitti affixed excessively tight handcuffs to Plaintiff's already-injured wrists and further accused Plaintiff of assaulting him. Lt. Selletti also released the vagrant and returned his tools to him. In the police car. Lt. Selletti further tightened Plaintiffs cuffs, leaving his wrists bruised and swollen. Plaintiff was taken to the 77th Precinct where Lt. Selletti learned Plaintiff had already complained of the burglary and was compelled to re-arrest the vagrant to cover up his misconduct. Plaintiff was wrongfully imprisoned for approximately 9 hours and released with a ticket for allegedly assaulting the burglar. After checking the identifications and asking several questions, Plaintiff was issued a ticket for driving through a red light. Plaintiff and his wife then drove away. Approximately one block later, officers pulled him over again. They approached Plaintiff's car with their guns drawn. Plaintiff was violently pulled from the driver's seat and assaulted by the officers. He was dragged, punched and kicked multiple times. He was struck several times with a police baton. Plaintiff was taken to the precinct handcuffed despite having committed no crime. He was then taken to the hospital where he was diagnosed with a facial fracture, abrasions to his face, arm, upper lip and lower left back. After he received treatment, he was taken back to the precinct, where he began to feel dizzy and collapsed into the bars of the jail cell. EMS transported him back to the hospital, where he was diagnosed with swelling to the top of his head. Plaintiff was charged with Assault in the Second Degree and other related charges. Eleven months later, all charges against Plaintiff were dismissed.
