Plaintiff handed over identification and explained to Defendants that he did not speak to customers. Plaintiff has been subjected to threats of deportation and false arrests in the past and decided to take it to court. Defendants never showed for Trial. Plaintiff 2: KANE On July 6, 2013 Plaintiff was in the area of Canal street in Downtown NY, assisting vendors place their products for sale. Without any provocation, John Does approached him, threw him against the wall, and yanked his hands behind his back. Plaintiff was taken to the 1st precinct and was charged for selling merchandise without a vendors license. False Arrest charges were dismissed. Plaintiff 3: DRAMMEH On April 17, 2013 Plaintiff went to Canal street to visit friends who assisted licensed vendors. Around 5:00 PM before even making it to his Uncle and friends, defendants Shapiro and Habermehl approached him with weapons out and told him not to move or \"we'll blow your brains out\". Defendants Shapiro and Habermehl put plaintiff in handcuffs and dragged him to the car by pulling his handcuffs over plaintiff's head. Plaintiff was taken to the 1st precinct. When Plaintiff asked to speak with a supervisor, Defendant Lino pointed a taser at plaintiff and told him to \"shut the fuck up\". He was given a ticket for disorderly conduct and appeared in court 7 times before the case was dismissed. Plaintiff 4: DIAWARA On March 4, 2014 Plaintiff was working as a vendor assistant when Defendant Faranda grabbed plaintiff by his neck,  threw him on the ground and arrested him for selling without a vendors license. Both Plaintiffs are black African immigrants. \nOn May 13, 2010, Plaintiff Fofana (\"FOFANA\") was standing next to a vendor who employs him as an itinerant when he was approached by two (2) unnamed NYPD Officers and ID'd. Fofana complied. Fofana was accused of speaking with customers and told he \"you have to go to jail\". Fofana denied speaking to customers and informed the officers that the vendor did all of the talking. Defendant John Doe 1 then told Defendant John Doe 2 \"you cannot arrest him\". Defendant John Doe 1 proceeded to arrest Fofana and kept the him in a police van for close to six (6) hours while touring the area and arresting other itinerants. Fofana was taken to the local precinct and falsely charged with violating two (2) administrative codes. Fofana was kept in a holding cell for eight (8) hours before being released. A third unnamed NYPD Officer ratified Fofana's arrest without checking the veracity of the information against him. Fofana was acquitted of the charges at trial. \nOn August 26, 2012, Fofana was again questioned and arrested by an unnamed NYPD Officer (\"John Roe\") regarding his work as a vendor's helper. Fofana insisted that he was selling products to customers. John Roe then said \"You are making me angry. You have to go to jail.\" Again Fofana was arrested and held for nine (9) hours in custody. After numerous court appearances the false charges against Fofana were dismissed. \nOn September 23, 2012, Fofana was giving directions to a female passerby who asked him for \"Prince Street\". NYPD Officer John Roe (the same unnamed officer from the August 26, 2012 incident above) approached Fofana and falsely stated that he was talking to the female passerby about the merchandise. Despite his explanation and protest, Fofana was handcuffed, arrested and driven around the area in a police van for six (6) hours. Fofana was denied access to a washroom during this time. While in the vehicle Fofana overheard the officers referring to an arrest quota: \"we need one more arrest before returning to the precinct.\"  Fofana was charged at the precinct and released seven (7) hours later. After numerous court appearances these charges were also dismissed. \nOn March 26, 2012, Plaintiff Diakite (\"DIAKITE\") was working as an itinerant for vendors. He was approached by unnamed NYPD officers and ID'd. Diakite was arrested accused of selling goods without a vendor's license. The charges were ultimately dismissed after numerous court appearances. \nOn April 10, 2012, Diakite was arrested on the same grounds in the same location. These charges were also dismissed after numerous court appearances. \nOn September 30, 2012, Diakite watched as NYPD Defendants approached a vendor and asked for the vendor's license. The vendor pointed to the license hanging at the front of his table. The Defendants left and returned 30 minutes later and requested Diakite's ID. He complied. Diakite was again arrested, detained and charged with violating administrative codes. These charges were dismissed after numerous court appearances. \nOn March 14, 2013, Diakite was arrested by NYPD Defendants Sanyshyn and Aryakia based on false charges related to unlicensed vendor sales. These charges were ultimately dismissed after numerous court appearances. \nOn October 4, 2013, Diakite was arrested in the same location and on the same grounds.
