As more defendant officers began chasing civilians, the plaintiff attempted to run but was grabbed, thrown to the ground, and jumped on by several officers. They repeatedly struck the plaintiff with fists, feet, and batons, causing injuries, and pinned him to the ground with their knees while stomping on his hand. None of the defendant officers present intervened to stop the excessive force and illegal arrest. The plaintiff was arrested with extremely tight handcuffs and transported to the 6th Precinct, where he was handcuffed to a bench for approximately seven hours while visibly bleeding. He was eventually taken to Central Booking and held until his arraignment. Defendant Matos signed a criminal court complaint, approved by Defendant Lewandoski, falsely accusing the plaintiff of striking an officer's helmet, resisting arrest, obstruction of governmental administration, and disorderly conduct. Mr. Cruz and Ms. Tavarez passed a drug store on Broadway and 4th Street with a broken front glass door. Mr. Cruz went into the store. While inside the store, Mr. Cruz heard Ms. Tavarez scream. He quickly left the store and, as he was leaving, seeing individuals in dark clothes rushing towards him. Plaintiff did not know the individuals were police officers. They did not identify themselves. After a few steps, Mr. Cruz quickly saw another group of individuals blocking his way. In this second group, he saw individuals on horseback and in riot gear and realized police were chasing him. The first officer to reach Mr. Cruz struck him on the head with a riot shield. Another officer then tackled Mr. Cruz to the ground. When Mr. Cruz fell, he was knocked unconscious. When Mr. Cruz regained consciousness, he was lying on the ground, handcuffed, and surrounded by officers beating him. \n\nEventually, the officers stopped beating him to interrogate him. Plaintiff was in intense pain and requested medical assistance. The officers refused, told him to be quiet, and ignored his injuries and complaints. Ms. Tavarez had used her cell phone to record the assault while it was happening, as well as Mr. Cruz’s condition after the fact. Officers approached her in a threatening manner, told her not to record. At no point was Mr. Cruz told he was under arrest. The officers who participated and/or observed include defendants Cherry, O’Connell, Montesdeoca, Kim, and  Morales. Mr. Cruz was taken into custody in a police van, which drove him to a precinct. While at the precinct, Mr. Cruz was subjected to an invasive pat-down search during which the searching officer, Defendant Matos, gratuitously and offensively handled his genitals. Throughout the process, multiple officers, including Defendant Matos, taunted Mr. Cruz and bragged that they could mistreat him without consequence. The officers cut parts of his clothes rather than confiscate them. Defendant Matos cut the drawstring of his hooded sweatshirt and, in doing so, quickly and threateningly brought a knife close to Plaintiff’s neck. Defendants Lee and Mendez observed and failed to intervene in these acts. Plaintiff continued to ask for medical treatment. Defendants refused any assistance and told him to shut up.  Mr. Cruz received no medical treatment the entire time he was held at the precinct.\n\nOn June 1, 2020, he was transferred to Central Booking. During intake, he was subjected to an even more invasive cavity search in which his anus was roughly penetrated by an officer’s hand. Officers also actively prevented Mr. Cruz from getting treatment from the medical staff during intake. The officers who mistreated Mr. Cruz at Central Booking included Officer Amir. After approximately 10 hours at Central Booking, other arrestees told officers that Plaintiff needed medical help. Plaintiff was examined by an EMT. He remained in custody but in a different cell. After sleeping for a short time, he was abruptly awoken by a horrible smell. He\nthen realized the new cell in which he had been placed had feces smeared on the walls. Mr. Cruz asked the police to transfer him back to the first cell, but they refused. In or around the afternoon of June 2, 2022, after approximately 30–40 hours in custody, Mr. Cruz was finally brought to court. The judge ordered that he be released on his own recognizance. \n\nShortly after he returned home, Police officers showed up,  looking for a girl who had gone missing in the last day. he told them he had been in police custody and therefore hadn't seen her. he asked if they had a warrant. they did not. They then asked if his name was David Cruz. when he said that it was. They said they did not need a warrant, they had probable cause. they began to search the apartment. when Plaintiffs mother came out of the back room. the officers gave her the same explanation that they gave plaintiff. to which she said they had nothing to do with it. they claimed it was their mistake and left. In the days after the incident,  Ms. Tavarez received multiple phone calls from individuals identifying themselves as NYPD officers demanding she destroy the video. At that time, Defendant Maloney and one other named Defendant pointed at Plaintiff and directed defendants Cheung, Shouldis, Ambrecht, and one other Defendant to walk toward Plaintiff. Defendant officers instructed Plaintiff and his cousin to move back, with which they complied, with Plaintiff raising his hands over his head as he stepped back. Defendant officers failed to inquire whether Plaintiff or the cousin were essential workers, and Defendants Cheung, Shouldis, Ambrecht, and one other grabbed and tackled Plaintiff to the ground, later joined by Maloney, Dones, Collarini, Cary, and Matos. Multiple Defendants, including Dones, Carey, Shouldis, Maloney, Cheung, Ambrecht, Collarini, and Matos, beat Plaintiff about the torso and legs, twisted his arms behind him, and struck his head with a police baton or other blunt instrument.
