During his custody, Defendant Police Officers provided false and misleading information to the DA and the Grand Jury, securing an indictment by falsely stating Plaintiff possessed the gun and failing to mention the anonymous caller's identification of Joey Osteen as the suspect. As a result, Plaintiff spent 95 days incarcerated on Rikers Island. Later, DNA evidence excluded Plaintiff from the gun, and at a suppression hearing, the search of the backpack was ruled unlawful, leading to the gun's evidence being suppressed.
