Defendant officers, including officers Charles Arnone (Shield No. 00408), Michael Gonzalez (Shield No. 05947) and Triston Trunk (Shield No. 03628), presented themselves at the residence on the basis of conducting a search of Ellington's residence pursuant to the terms of Ellington's parole. Ellington was was seized by defendants and placed into parole cuffs in an excessively tight fashion. Defendants then illegally stopped, seized, and detained Plaintiff-Perry and other lawful residents within the premises. Subsequently, defendants performed an unlawful search in an invasive and destructive manner, before allegedly recovering contraband from a safe located therein. Defendant-officers then seized plaintiffs Ellington and Perry, placed each plaintiff in excessively tightened handcuffs, and ignored plaintiffs' requests to loosen said handcuffs. Plaintiffs were arrested, processed, arraigned and subsequently remanded to Rikers Island Correctional Facility.  Defendant-officers maintained their misrepresentations to further the arrest, detention, and prosecution of the plaintiffs. Plaintiffs were targeted solely on their status as African American/Black or Hispanic/Latino males. \n\nAt Rikers Island Correctional Facility, both plaintiffs were subject to numerous batteries by other inmates or correction officers.  On January 26, 2022, plaintiff-Perry was released from physical custody.  On September 1, 2022, all adverse charges pertaining to Plaintiff-Perry were dismissed and sealed on the merits. On December 22, 2022, plaintiff-Ellington was released from physical custody. Defendants falsely alleged that they recovered illegal drugs and ammunition from inside of closed containers recovered from a room where plaintiff was not present. Plaintiff was then transported to Central Booking. The next day, plaintiff was arraigned and released from custody. The Defendants then illegally interrogated the Plaintiff in violation of his rights despite them not finding anything indicating the Plaintiff had illegal items or did a crime. After Defendants handcuffed the Plaintiff, he requested the officers to loosen them due to their excessive tightness. Instead, the Defendants intentionally squeezed the Plaintiff's hands to cause him more pain. This action resulted in the Plaintiff's risk of having contusions, swellings, and loss of feeling in them. Defendants then transported Plaintiff to the 63rd Precinct where he was criminally prosecuted and transported to a lower room in the precinct. While handcuffed in the lower room, the Defendants brutally slapped the Plaintiff and punched his Plaintiff's face, stomach,  body, and diaphragm, causing him asphyxiation. Defendants insisted that them assaulting the Plaintiff was lawful and would only stop if the Plaintiff made incriminating statements about himself. \n\nDefendants then transferred the Plaintiff to central booking, where he was again criminally processed, illegally interrogated, slapped, and punched. Defendants then signed a supporting deposition falsely swearing and alleging that Plaintiff criminally possessed and sold narcotics and attested that they observed such despite knowing that Plaintiff did not participate in any legal activity nor there was any probable cause to the District Attorney's office so the Plaintiff could criminally prosecute Plaintiff. The Plaintiff remained falsely imprisoned for two days. Plaintiff believes that the Defendants discriminated against him solely due to their perception of him being a young African-American male, his immigration status, etc. The Plaintiff's charges were dismissed on or about August 5th, 20219.
