Defendant NYPD Officers Garcia, Kessba, and Ritchie stopped the vehicle and ordered plaintiff to exit the vehicle. When plaintiff complied, defendant Garcia searched him without probable cause or reasonable suspicion. Defendants did not find anything, and plaintiff objected to further searching. Defendant Garcia then struck plaintiff, knocking him to the ground.\n\nWhen defendants picked plaintiff up off the ground, they also picked up a firearm which had not been on plaintiffs person. Nevertheless, defendants arrested plaintiff, swore out a false complaint, and gave false testimony to charge defendant with criminal possession of a firearm and resisting arrest.
