On August 11, Plaintiff was lawfully present on a street corner when Defendant POs, including Defendant CASTILLO unlawfully stopped, searched, and arrested Plaintiff despite having no reasonably suspicion or probably cause. At the time of the August 11 arrest, Plaintiff lawfully possessed a box cutter for work. Defendant POs falsely accused Plaintiff of \"possession of a box cutter with intent to use\" and informed employees of the Bronx DA that they had observed Plaintiff commit crimes. The Bronx DA decided not to prosecute Plaintiff. Immediately following Plaintiff's release on August 13, Defendant POs, including Defendant CASTILLO targeted and falsely arrested Plaintiff. Defendant POs arrested Plaintiff for criminal mischief, falsely alleging that Plaintiff broke a window. Defendant POs arrest of Plaintiff was not supported by probable cause and the Bronx DA again declined to prosecute Plaintiff. Plaintiff was released from custody without any criminal charges being filed.
