While there, Defendant Blackett, a New York City police officer, who was already inside, appeared from behind a door with his pistol drawn and fired point blank at the Plaintiff's face. The Plaintiff was in the face and right eye with fragments from the discharged bullet. The Plaintiff fell to the ground bleeding, unable to see or hear. Defendant Blackett apprehended the Plaintiff while he was on the ground and pulled him into a standing position, then walked him towards some steps. The residents of the location rushed to the room after hearing the gunshot and confronted the defendant but Defendant Blackett pointed his gun at them and held everyone in place. Even though the Plaintiff required medical attention, Defendant Blackett failed to provide or request it. Defendant Blackett ordered someone to call the police and held everyone at gunpoint until Defendant Gourlay and other defendants arrived. \n\nDefendants conspired amongst themselves to falsely accuse the Plaintiff of trespass and robbery. The residents protested the Plaintiffs arrest but were told to be silent. Plaintiff's demands to be taken to a hospital were also denied. Plaintiff was only allowed treatment by an ambulance. This treatment was inadequate and he was placed inside a police vehicle with shrapnel still in his eye. The Plaintiff was driven to the precinct and during the ride demanded to be taken to a hospital. Again he was denied. At the precinct, the Plaintiff was again denied medical attention and he was placed in a holding cell. During the drive, Carbone saw a marked police car and an ambulance near the intersection and pulled over to speak with P.O. John Redhead. Carbone was upset and seeking help for her sister who was bleeding from her head; her sister had slipped on ice and hit her head on concrete. John Redhead was rude, dismissive, and unhelpful. Carbone continued to try to seek assistance from Redhead. Redhead then placed Carbone under arrest for disorderly conduct and resisting arrest P.O. used excessive force in handcuffing her. She was held for 24 hours before being arraigned.
