The defendants had no probable cause or reasonable suspicion to believe that the plaintiff was engaged in an illegal activity. The search yielded no evidence of any guns, drugs or contraband. Despite the absence of any evidence of wrongdoing by the plaintiff, the defendants applied excessively tight handcuffs, formally arrested the plaintiff and transported him to a local precinct. Plaintiff was transferred from the precinct to New York County Central Booking where he was arraigned on a criminal complaint sworn to and made on the basis of false allegations supplied by the defendants. The plaintiff was then released from custody after seeing a judge. As a result, plaintiff was forced to make several courts appearances over the course of several months, pursuant to the false allegations made by the defendants before the charges against him were dismissed.
