The Officers unreasonably used force while arresting Mr. Long. At no point did Mr. Long resist arrest. During the execution of the warrant, the Officers also seized around $5,000 from Mr. Long's closet. Mr. Long was arraigned and released on his own recognizance. Mr. Long returned to court four times and each time entered a not-guilty plea. Mr. Long moved to suppress the evidence recovered from the search by challenging the legality of the search warrant. The prosecution did not oppose the motion to suppress. When asked for the reason of his arrest, the officers claimed that the plaintiff had obstructed their entry into the premises and that they found the plaintiff in the backroom of the house where the raid took place with a backpack full of drugs. The Plaintiff was then taken to Central Booking to await arraignment.\n\nWhile in Central Booking, Defendant Lallave and Defendant Maloney conveyed false information to prosecutors, in order to have the Plaintiff charged with: Criminal Sale of a Controlled Substance in the Third Degree, Criminal Possession of a Controlled Substance in the Third Degree, Criminal Possession of a Controlled Substance in the Fifth Degree, and Criminal Possession of a Controlled Substance in the Seventh Degree. The Plaintiff, who did not possess or sell heroin or engage in illegal conduct on April 19, 2013, was arraigned on those charges and spent approximately 30 hours unlawfully in police custody. At arraignment, the Honorable Judge Parker released the Plaintiff on his own recognizance and the matter was adjourned for grand jury action. On June 6, 2013, the Plaintiff was indicted by a Kings County grand jury.
