On February 15, 2012, in the schoolyard of JHS, the Plaintiff was assaulted and struck by another student. Thereafter, while in the cafeteria of JHS 014, the Plaintiff was caused to be removed, seized and confined by the defendants, Tully, Lagasa and Bryant (\"School Defendants\"). The School Defendants were advised by the Plaintiff that he committed no crime but was the victim of an assault and battery and attempted to defend himself to prevent further and additional injury. The School Defendants, without notifying the Plaintiff's parents, caused, permitted and allowed NYC Police Officer Cucuzza and NYC Police Officer \"John Doe\" to falsely arrest, imprison and handcuff the infant Plaintiff behind his back, take him out of the school in view of other students, teachers and other persons, place the Plaintiff into a NYCPD vehicle and was brought to the 61st Precinct. There was no warrant for the Infant Plaintiff's arrest. \n\nAt the 61st Precinct, Police Officer Cucuzza and NYPD \"John Doe\" (\"Police Defendants\") interrogated, falsely arrested and imprisoned the infant Plaintiff Omar Yasin and treated him like a hardened criminal; he was placed into a room and handcuffed to a wall for approximately three hours; he was denied food and drinks; he was denied access to a legal counsel and was denied access and permission to see and speak with his parents, Lisa & Omar Yasin, SR, even though they were present at the 61st Pct. for the 3 hours of incarceration and repeatedly demanded to see and speak with their 13 year old child. \n\nOn May 17, 2012, a Mock Court Trial at the Brownsville Youth Court was prosecuted by Steven Costigliacci on behalf of the Police Defendants and Plaintiff was found not guilty and it was determined that his aforesaid actions to defend himself from further injury after the assault and battery against him in the schoolyard on February 15, 2012 were justified. The Defendant City of New York refused to file a petition and refused to file any charges against the 13 year old infant plaintiff, Omar Yasin. A notice of Declination dated June 4, 2012 was issued by the defendant City of New York.
