Defendant Scoloveno removed from his vehicle, patted down, arrested, and rear-cuffed Plaintiff. Plaintiff was taken to a precinct, where Defendant Officer Jason Sharp confronted him. Defendant Sharp arrested Plaintiff for the illegal possession of marihuana that allegedly happened on February 19, 2010, at 6:30 a.m. on the street. Even though Defendant Sharp claimed under oath that he observed Plaintiff in possession of this marihuana on February 19, 2010, at 6:30 a.m. at a particular place, Plaintiff was never there at this date and time. Defendants committed the Plaintiff’s arrest without legal process and probable cause. On or about March 10, 2010, he was arraigned for two separate criminal complaints.\n\nOn June 21, 2010, the Defendant Sharp case was dismissed and sealed.
