The Plaintiff took photos of NYPD officers violently arresting people. NYPD was also using an LRAD (long range acoustic devices) to deter protestors. The noise gave the Plaintiff immense pain that turned into a migraine spread to the entire face. The Plaintiff was feeling very dizzy, confused, and scared. She managed to make it back home but had a migraine headache and felt facial pressure for around the next week. Ever since, the Plaintiff has become much more sensitive to noises, and even experiences ringing daily. \nOn December 5, 2014, Plaintiff Horse attended protests in Manhattan as a freelance photojournalist. The Plaintiff saw POs violently arresting protestors while using batons and pepper spray. Then the Defendant Officers Maguire and Poletto pointed the LRAD at the Plaintiff. The Plaintiff experienced migraine headaches and extreme ringing/pain in his ears. The Plaintiff is uninsured, so he was unable to receive treatment and thus still experiences ringing in his ears and dizzy spells to presently. \nOn December 4, 2014, Plaintiff Craven intended to document the protests in Manhattan and the police response. The Plaintiff saw people gathering around the police making arrests, and without any warning, the LRAD was used. The next day, the Plaintiff suffered from severe pain and ringing in both ears. \nOn December 4, 2014, Plaintiff Stephan attended the protests in Manhattan to observe and document police response/protestors. The Plaintiff was observing an officer make an arrest, when he felt his eyes begin to burn from pepper spray. The Plaintiff felt pain, itching, and burning, and ran away from the scene. While leaving, the police began firing the LRAD, which caused the plaintiff tremendous ear pain. \nOn December 5, 2014, Plaintiff Nusbaum joined the protests in Manhattan as a filmmaker and protestor. The Plaintiff had a pre-existing hearing condition, and thus when the NYPD used the LRAD, he experienced a significant amount of pain. \nOn December 4, 2014, Plaintiff Appel joined the protests in Manhattan. When the LRAD went off, the Plaintiff developed a very severe headache that lasted for 3 days.
