Defendants asked Plaintiff for identification, to which Plaintiff complied. Defendant John Doe attempted to grab Plaintiff's arm but then Plaintiff pulled back, Plaintiff was then put in a bear hug and picked up in the air and body slammed face first onto the concrete pavement and his head, face and back were beaten. Plaintiff's mother was watching this ordeal and yelled out that Plaintiff has scoliosis but the Officers kept battering and assaulting him. Plaintiff was held on the ground and handcuffed for 20 minutes before being escorted to his feet and was falsely arrested. Plaintiff was forcibly taken to a police vehicle where Officers then yelled stop resisting and their misconduct was being recorded. Plaintiff was never resisting but was slammed into the police vehicle and officers hindered the recording of their misconduct by shining their flashlights into the lens of the cell phone camera. Plaintiff was then assaulted in the back of the police vehicle on the way to the Precinct by Jim Doe who punched Plaintiff in his chest. At the Precinct Plaintiff's sneakers were falsely vouchered as arrest evidence. Plaintiff's case was dismissed but his sneakers were never returned and never vouchered. Officer's removed Plaintiff's sneakers and he was shackled. Plaintiff complained of the pain he was experiencing while detained but was denied medical treatment. Plaintiff remained in handcuffs. and in police custody until he was arraigned at New York County Criminal Court. Plaintiff was released on his own recognizance at Arraignment. Plaintiff's case was dismissed on August 22, 2017, his first Court appearance pursuant to the District Attorney's Office motion.
