A cop car pulled up alongside him. Officer Valdez asked Plaintiff, \"Can I talk to you for a minute?\", Plaintiff responded \"for what\" and kept walking. Valdez exited the car and Plaintiff began to run. Other officers caught plaintiff, pushed him onto the floor and searched him but found nothing. Plaintiff was taken to the precinct and accused of being involved in a shooting at club C-Pac that night. Officers had recovered a gun. Plaintiff was arrested for criminal possession of a weapon in the second degree. Bail was set for $1,000. Plaintiff was sent to Rikers Island for 6 days and bailed out on December 30, 2010. Plaintiff went back to Rikers on January 8, 2011 to retrieve personal items and returning home found police with an arrest warrant. Police cuffed plaintiff's arms and ankles and transported him to the 67th Precinct. Plaintiff was placed in a lineup and picked by a witness. The court set bail at $10,000 and plaintiff was sent to Rikers Island for four months. At court in April 2010, the attempted murder case was dismissed for lack of evidence. Plaintiffs prior case was reinstated and bail was again set at $1,000.
