Uniformed officers approached the plaintiff's window, requested his license and registration, and then asked him to step out of the vehicle without explanation. The plaintiff was subjected to an unlawful pat-down search, instructed to stand at the rear of the vehicle, and his car was unlawfully searched. One officer took the plaintiff's keys without permission to open the trunk. The plaintiff was then arrested, taken to the 73rd precinct, unlawfully fingerprinted, photographed, and placed in a holding cell. The defendants falsely claimed they found a firearm in the trunk, which the plaintiff knew nothing about. The following day, the plaintiff was transported to Kings Central Booking, where he was again unlawfully searched and placed in a holding cell. After approximately 30 hours in custody, he was arraigned in criminal court on December 13, 2020, accused of criminal possession of a firearm. A parole hold was placed on the plaintiff based on the officers' false allegations, and he was remanded to Rikers Island Correctional Facility. On March 6, 2021, following a DNA comparison of the gun, the Kings County District Attorney's office dismissed all charges, lifted the parole hold, and the plaintiff was released from Rikers Island after approximately 90 days in custody.
