NYPD officers surrounded the protesters on all sides and played a recording stating that protesters must disperse. NYPD Officer Jorge Garcia pushed Ms. York, who verbally expressed to Garcia that she couldn't move because she was trapped. Garcia ignored this information and continued pushing Ms. York on her shoulders and chest. At some point, an NYPD supervisor gave a command to arrest the protesters. Garcia and Officer John Doe 1 grabbed Ms. York and threw her onto the street, which caused her to fall and lose her cane. Ms. York was then handcuffed with zip-tie plastic handcuffs by Garcia while she was lying facedown on the ground. She was then picked up off the ground by officers who couldn't see, and then slammed into the side of the car by Officers John Does 2 and 3. \n\nJohn Doe 2 then searched Ms. York, grazing her genitals through her underwear with his hand multiple times. Ms. York cried and spoke up to state she was a transgender woman being inappropriately searched by male officers, but John Doe 2 ignored her, ridiculed her, and continued the search. John Doe 3 did not  intervene. John Does 2 and 3 placed Ms. York in an NYPD van and tightened her cuffs in an extraordinarily tight manner. Ms. York immediately experienced excruciating pain from the handcuffs and lost feeling in her hands. Ms. York repeatedly complained the cuffs were too tight, and the Doe Defendants ignored the complaints. At the precinct, officers repeatedly misgendered Ms. York by using he/him pronouns to describe her and bringing another man to her cell, despite her making explicitly clear that she is a woman. This protest followed many others in the wake of the murder of George Floyd. The protest took place in McCarren Park in Brooklyn, at or around 7:00pm, with a march scheduled for 8:00pm. Before the march could begin, Plaintiff and other protesters were surrounded and trapped by NYPD officers. The NYPD officers played an LRAD recording that ordered protesters to stay out of the street. However, Plaintiff and the majority of other protesters were not in the street, they were already on the sidewalk. Plaintiff and other protesters also could not disperse because the NYPD officers had blocked all egresses. \n\nAt some point, NYPD Officer Captain Julio Delgado gave a command to arrest the protesters. Officer Doe 1 hit plaintiff in the back of the head, from behind, without warning. Then, Officer Does 2 and 3 threw Plaintiff against a vehicle. Officer Does 4-6 and Captain Delgado then shoved Plaintiff against the vehicle and forced him to the ground. Officer Doe 6 ripped off one of plaintiff's gloves and threw it into the street and applied zip tie handcuffs that were extraordinarily tight, such that Plaintiff's hands changed color and he began to lose feeling in his fingers. Within five minutes, a supervisor removed Plaintiffs' cuffs, but Plaintiff had already suffered permanent damage. Officers had also removed Plaintiffs' face covering used to protect against COVID-19, and did not replace it. Officers then loaded Plaintiff and 7-9 others onto a police van and took them to a mass arrest processing center. There, Plaintiff was put in unsafe and overcrowded confinement that did not comply with New York's social distancing requirements, and without appropriate access to phone calls, food, water, bathrooms, soap, and other basic necessities. NYPD officers also destroyed or damaged Plaintiff's property while Plaintiff was in confinement. At approximately 2:30am, Plaintiff was released with a Desk Appearance Ticket signed by Officer Justin Schivek.
