Plaintiff told the officers that the lessor was not present. The two landlords of the commercial space told the officers that Plaintiff was lawfully present inside of the leased commercial space and that he worked for the lessor. The officers spoke to the lessor by phone and learned that he was not inside the leased commercial space or even inside the building. They unlawfully told Smith that he was required to open the door to the leased space, despite knowing that the lessor was not present and that Smith had not violated any law. They violently broke into the leased commercial space to unlawfully and violently arrest Plaintiff and charged Plaintiff with Obstructing Governmental Administration in the Second Degree and Trespassing. When the lessor arrived, he was arrested. To punish Plaintiff, the officers brought him to a hospital for psychiatric evaluation despite the fact Smith did not exhibit any signs of emotional or psychiatric distress.
