About 10 minutes after the plaintiff's acquaintance went to a grocery store on Livonia Avenue the Plaintiff heard five to seven gunshots coming from the direction of the store.  Plaintiff, who is an African American male, proceeded towards the store to see if his friends or anyone else he know was injured in the shooting.  Upon Plaintiffs arrival, there were already Police Officers present on the scene and they were clearing civilians from the area.  One of the officers pushed the Plaintiff to get him to clear the area and so he moved down the street.  Within minutes Plaintiff was approached by Defendants Police Officer \"John\" Azize and Police Officers \"John Does\" 1-3.  One of the Police officers grabbed the Plaintiff's jacket sleeve and then let him go and the Plaintiff began walking away again.  After the plaintiff turned the corner one of the Defendant Police Officers knocked him to the ground from behind.  The Plaintiff got back up he asked who had pushed down, and then one of the officers put Plaintiff in a chokehold and violently flung him to the ground.  The officers jumped on top of the Plaintiff and continued to choke him and eventually rolled him onto his stomach and handcuffed him. Plaintiff was dragged to a police and one of the officers threatened to punch him in the face if he did not \"shut up\". Throughout the entire incident, Plaintiff's hands were down to show he was not fighting or resisting in anyway.  Plaintiff was taken to the precinct, PSA 2, searched, had his personal effects confiscated and left in a cell for two hours before being issued a summons for \"disorderly conduct\" and released.  Plaintiff then returned to his friends and an ambulance was called and transported Plaintiff to Brookdale hospital where he was treated for a large laceration on his right knee, a bruise on his forehead, pain and swelling in his neck among other injuries.  The summons was dismissed as legally insufficient on September 4, 2012.
