Without provocation the security guard again aggressively approached, chest bumped Plaintiff, pushed Plaintiff backward, then grabbed Plaintiff's arm and refused to let him go. Additional guards arrived, threw Plaintiff to the ground, and handcuffed him. PO Edward Montoya, Sgt. Carlos Medina, and POs John Does 1-10 responded, reviewed surveillance footage, and agreed Plaintiff was the victim of an assault. Nevertheless POs falsely arrested Plaintiff, shoved him out of the building, and transported Plaintiff to the 33rd Precinct. Plaintiff was charged with Obstructing Governmental Administration and Harassment, and remained in unlawful custody for approximately 24 hours. Plaintiff was compelled to return to court on approximately 6 occasions before all charges against him were dismissed on May 13 ,2013.
