The plaintiffs denied the accusation, but Torem proceeded to viciously attack them, without justification or provocation. The attack included both punching and kicking to both plaintiffs, causing severe injuries to Fernandez's knees and lacerations to his body as well as a head contusion and other severe injuries to Fleming. \n\nFollowing the assault, Torem falsely informed the NYPD that the plaintiffs had assaulted him. While the plaintiffs were leaving the scene and headed to the parking lot, several unidentified NYPD officers, including Officer Gonzalez, then approached the plaintiffs without probable cause and assaulted them using excessive force, without justification or provocation.
