Plaintiff ran to the scene and after checking for any injured persons, tried to restrain the driver of the car that crashed who was trying to flee. Plaintiff was getting assaulted by that driver, and Plaintiff waived down a passing police vehicle containing defendant Guerriere. Plaintiff told Guerriere the events that occurred, and Guerriere told Plaintiff he should stay out of police business and that he was going to arrest Plaintiff for not staying out of police business. Guerriere arrested Plaintiff and charged him with felony traffic laws and driving without a license, claiming Plaintiff operated the vehicle while intoxicated. Guerriere conceded Plaintiff was not operating a vehicle when he encountered Plaintiff. Guerriere's complaint contained lies, false claims. and omissions of fact. \nPlaintiff ended up spending several days in the NYC Department of Correction, where he was assaulted. On August 16, 2013 a Queen County Grand Jury dismissed Guerriere's criminal claims against Plaintiff.
