During the conversation with the Defendants, Plaintiff was at arm’s length or more from them, did not position herself between the arrestee or the officers, and did not touch or push any of the officers. After Plaintiff walked away from the officers, Officer Rosario told Sergeant Brito, “That woman is lying,” to which Sergeant Brito pointed at Plaintiff and ordered her arrest. \n\nWhile the Plaintiff was in custody, she was subjected to harassment. Officer Diaz and Officer Rosario made racial and sexual threats, such as asking whether she had “learned her lesson” and asking, “What would happen if you were raped? Would we come to your assistance?” The Defendants submitted false reports to the District Attorney, resulting in a charge of obstructing governmental administration. Officer Rosario, in particular, falsely claimed that Plaintiff jumped between her and the arrestee, pushed her away to prevent the arrest, and told her that she got involved because she watched a documentary, was traumatized, and that the officers reminded her of those unfairly targeting Black and Hispanic people. All charges against the Plaintiff were ultimately dismissed.
