After approaching the vehicle, Detective McKevitt ordered Plaintiff out of the vehicle on the pretext that he smelled marijuana in the vehicle, before handcuffing and arresting him. Plaintiff was subsequently taken to a precinct, and interrogated for the offences of rape and sexual abuse which he did not commit. Whilst Plaintiff was being transferred to Rikers Island, he was forced to remain in a police van for 5 hours, with his hands handcuffed behind his back. This left him with a permanent injury to his left arm and middle back.
