Westmoreland was handcuffed and brought to the precinct before being transferred to Central Bookings. Westmoreland was charged with obstruction of governmental administration, resisting arrest, and attempted assault. Officer Scalcione falsely claimed that Westmoreland was pulling on the back of his jacket while placing Clinton under arrest and was attempting to punch Officer Ernyey. Ernyey and several unidentified police officers, apparently angered by Plaintiff's failure to stop, ordered Plaintiff to pull over and threatened to kill him if he failed to comply.\n\nPlaintiff, fearing for his safety and not wishing to pull over alone in an area without bystanders, attempted to continue driving to his girlfriend's residence, intending to stop and interact with the officers there, because he knew other individuals would be around. The police van struck the rear of Plaintiff's vehicle, causing Plaintiff to be thrown from the vehicle. Plaintiff initially attempted to flee but quickly ceased running and stopped, placing his hands behind his back. Defendant police officers struck Plaintiff with their batons about his legs and torso, threw Plaintiff to the ground, and punched and kicked Plaintiff in the face, torso, and back. As a result of this unprovoked assault, Plaintiff sustained injuries to his face, ribs, back, and legs. Plaintiff's injuries are severe and grievous, and Plaintiff was and will be confined to hospital and/or bed and/or home for a considerable period of time and will be unable to participate in or attend to normal activities and employment.
