The Defendant officers approached the vehicle, one on the driver's side and one on the passenger side. They requested the Plaintiff's license and registration which he then provided. Defendant Sgt. Doe 1 then approached the vehicle and ordered Plaintiff and his acquaintance to get out of the vehicle. Afraid of making sudden movements, Plaintiff requested that an officer reach into the car and unlock the door so that he could get out safely. In response, a police officer reached in and unlocked the door. Before the Plaintiff could get out by himself, one of the Defendants reached in, grabbed Plaintiff by the throat, choked him, and pulled him out of the car. Defendants then put Plaintiff chest-first against the car and at least one of the Defendant officers, believed to be Sgt. Doe 1, punched Plaintiff in the torso while the other Defendants just looked on. The Defendants then tightly rear-cuffed the Plaintiff causing pain, threw him to the ground, picked him up and slammed him to the pavement, and eventually picked him up and threw him forcefully into his car. The Defendants brought Plaintiff to a nearby precinct stationhouse and then to Brooklyn Central Booking. Based on Defendant officer Reda's testimony, Plaintiff was charged with several violations. Plaintiff was offered an adjournment in contemplation of dismissal, which he accepted and resulted in the dismissal of the charges.
