Mother passed away on March 1, 2012, at her friend's house. Davis was called to the scene of Mother's passing. Mother's friend called plaintiff to let him know his mother had passed and put Davis on the phone who conveyed to plaintiff a family member needed to come to confirm Mother's identity. Plaintiff sent his sister, Francesca, to identify Mother's body, and confirmed there was no arrest warrant for plaintiff. On March 13, 2012, Davis and another Defendant arrested plaintiff at his workplace for violating the TOP previously vacated on February 21, 2012. Davis proceeded to process plaintiff's arrest.  Davis failed to confirm the TOP had already been vacated.
