The arrest was done following an investigation done by the Defendant Officers. \n\nOn May 27, 2011, an attempted robbery occurred at a Metro PCS in Brooklyn. Plaintff was not connected with the robbery, but was a customer prior it occuring. Plaintiff was not in the store when the robbery happened, and Plaintiff had never stolen anything from the store. The description of the robber did not fit the physical apperance of the Plaintiff whatsoever. Plaintiff was picked out of a police staged line-up but the identification was found to be the result of unlawful suggestion by law enforcement. \n\nThere was video surveillance that Defendant Officer’s had and they knew it did not depict the Plaintiff, but the arrest was initiated against Plaintiff. The video surveillance was not disclosed in a timely manner. Still, Defendants Det. William Waldron, Sgt. Anthony Longbardi, P.O. Tomas Reyes, Lt. Michael Culkin, the District Attorney’s Office of Kings County, D.A. Charles J. Hynes, ADA Lecia Griepp, ADA Leila Rosini, ADA Lindsey Lieberman, and ADA Ernest Chem initated a criminal prosecution against Plaintiff, charging him with attempted robbery, attempted petit larceny and criminal possession of a weapon. \n\nOn January 17, 2023, the Defendants did not move forward with the prosecution and Plaintiff was released from jail. On February 4, 2013, all charges were dismissed against the Plaintiff.
