NYPD Officers including Defendant Officer Frank, approached the vehicle. Frank opened the passenger door and ordered Reed to exit. The driver confirmed to the officers that Reed had paid the fare for Julian Tumma, who had just exited the cab, and he was transporting her to a second location.  The other officers grabbed Tumma after he exited the cab and slammed him over the hood of the car. Reed tried to record this, but the officer confiscated her cell phone. Frank removed Reed from the vehicle and searched her without her consent, finding no contraband. The officers then arrested Reed, and when she asked for the reason, they told her once that it was on and outstanding warrant and at another point that it was due to the contents of a bag officers had confiscated from Tumma. There were no warrants for her arrest, and the police only found a toy gun in the bag. Reed was transported to the 46th Precinct, where she was searched and placed in a holding cell then transported to Bronx Central Booking at approximately 5:00AM on February 23. She was held in a locked holding cell till 10:45PM, when she was informed that her case had been dismissed without her ever seeing a judge. \n\nWhile Reed was in police custody, officers unsuccessfully attempted to forcibly gain entry into her home, leaving marks on her door, and questioned her neighbor. On March 9, 2018, Reed was at her home at 1490 Boston Rd Apt. 4n, Bronx, NY, when plainclothed NYPD officers, including defendants Frank and Wallace, knocked on her door and asked her to lower her music. They then prevented her from closing the door and pushed into the apartment. Frank pointed his weapon at Reed's friend and her son, and Wallace claimed they had a warrant, that the complaint alleges was obtained with false, misleading, and unreliable information presented to the judge. Reed waited outside while the police searched the home. The officers failed to find a firearm, and stated that they were not leaving there empty handed. They also threatened to call Reed's job to \"tell them what you are doing.\" After searching the apartment, they gave her a summons for traces of marijuana found in an ashtray.
