While waiting, officers entered the restaurant and questioned the owner about a disturbance. Knowing that the owner spoke little English, Plaintiff attempted to assist and told the officers that he saw no disturbance in the 20 or so minutes he had been at the location. The officers told him to not get involved. Plaintiff replied that he was merely trying to help as a witness. Officer Phillip Gustavino then pushed Plaintiff and told him to leave the restaurant. Plaintiff refused as he was still waiting for his order and went to sit down. Officer Gustavino responded by grabbing Plaintiff by the arm, forcibly removing him from the premises and slamming him against a police vehicle. The other officers watched Gustavino and failed to intervene. Another officer assisted Gustavino in arresting Plaintiff. At no time, did Plaintiff resist. While placing him in the vehicle, an unidentified officer caused Plaintiff's head to hit the vehicle which resulted in lacerations and bodily contusions that required treatment at Bellevue Hospital before Plaintiff was transported to the 17th Precinct for fingerprints and detention at central booking. At his arraignment, Plaintiff was charged with Second Degree Obstruction and Resisting Arrest. He was released on his own recognizance.
