Despite the absence of any evidence of wrongdoing by the plaintiff, the defendants applied excessively tight handcuffs, formally arrested the plaintiff and transported him to PSA where he was fingerprinted, photographed and placed in a holding cell. Plaintiff was thereafter transported to Kings County Central Bookings, where he was again processed and placed in a holding cell. While in custody, the defendant police officers provided the DA with the false information that Plaintiff committed Criminal Possession of a Weapon in the Second Degree. At plaintiff’s arraignment, the judge imposed $30,000 bail based on the officer’s false paperwork, which plaintiff could not afford. As a result, the plaintiff was unlawfully imprisoned until May 1, 2022. Defendants P.O. Jason L. Smith, P.O. Joseph C. Sicari, and other unidentified officers detained Spann at gunpoint, directing him to lie on the ground. While he complied, the officers proceeded to kick him, pin him down with their knees on his head, and tightly handcuff him, causing cuts and bruises to his wrists. Despite being handcuffed and subdued, the officers continued to physically assault him, resulting in serious injuries. Spann was also subjected to an illegal search, which yielded no contraband. He was later transported to the NYPD-73rd Precinct and detained before being released after prosecutors declined to press charges.\n\nA similar incident occurred on August 25, 2019, where Spann was again arrested without cause near the corner of Mother Gaston Boulevard and Sutter Avenue in Brooklyn. During this arrest, the officers kicked and tripped him, causing him to fall and sustain further injuries. Spann was once again tightly handcuffed and beaten by the officers, who ignored his requests for medical treatment.
