Kessler is mentally disabled and suffers from autism, bipolar disorder, Asperger’s and Tourette’s syndrome.  Due to these mental disabilities, Kessler took medications that caused him to urinate excessively and that triggered immense pain in his bladder in the event he was unable to urinate frequently and as needed.  Plaintiff was taken to Queens General Hospital by Officers Sotiriou and Javed, where he was evaluated as an emotionally disturbed person before being taken to and held at the precinct.  Plaintiff advised defendants Sotiriou, Javed and DiChristina of his medical condition and the pain he would suffer in the event he was unable to use the restroom as needed.\n\nKessler was forced to remain in a cell for 11 hours without being given the right to use the restroom, despite his pleading, begging and repeatedly telling defendants of his pain, which required Kessler to urinate on himself in order to alleviate his discomfort.  Defendants taunted Kessler and mocked him for his mental disabilities.  During the 11-hour period, defendants allowed others in the holding cells to use the bathroom upon request. Plaintiff called 911 and was chased out of her apartment by her boyfriend, who tackled her and began beating her. Defendants arrived at the scene and removed plaintiff's boyfriend from on top of plaintiff. Despite plaintiff's explanation that she had been defending herself from her boyfriend's attacks, defendants arrested plaintiff. Defendants also refused to to collect as evidence the scissors used to stab plaintiff. Plaintiff was transported to the hospital and then to the 109th precinct. While being held in Queens Central Booking, plaintiff informed defendant Warnett that she needed medical attention. Defendant Warnett ignored her pleas for hours. Defendants fabricated evidence to justify plaintiff's arrest.
