Plaintiff began to record the arrest with their cell phone, but when Defendant Officers saw Plaintiff recording they yelled to stand back. Defendant Officers grabbed the phone out of Plaintiff's hand causing it to fall onto the ground, where the officers stopped others from picking it up. Defendant Officers picked the phone up and handcuffed and arrested Plaintiff without probable cause. Plaintiff was searched and no illegal items were discovered on their person. Plaintiff was transported to the Precinct and detained before being transported to Central Booking for many additional hours. Defendant Officers provided the District Attorney's office with misleading and incomplete evidence, charging the Plaintiff with Obstructing Governmental Administration and Disorderly Conduct. Defendants noticed the recording, screamed at him to stand back, and grabbed his phone from his hand.  His phone fell from his hand onto the ground. Defendants picked up the phone, unlawfully handcuffed Plaintiff, and falsely arrested him without probable cause or legal justification. Following his unlawful seizure of plaintiff, P.O. Morgante arrested Mr. Peak without a warrant and without probable cause to believe that Mr. Peak had committed or was about to commit any crime. After arresting Mr. Peak, P.O. Morgante imprisoned him against his will at\nvarious locations, including a police van and a police precinct.\n\nSubsequently, P.O. Morgante initiated a prosecution of Mr. Peak by charging\nhim with crimes of which he was innocent and of which Morgante did not have probable cause to believe he was guilty. In support of the prosecution, P.O. Morgante authored and signed a Criminal Court Complaint in which he falsely charged Mr. Peak with various crimes and intentionally made statements and accusations against plaintiff that he knew were false. On or about March 3, 2022, after being prosecuted for over one year, all criminal charges against Mr. Peak were dismissed on the merits.
