The man who committed the robbery fled the subway station. The victim badly beaten, with a bleeding, bruised and swollen face, approached Plaintiff and another bystander on the platform and asked for help. Plaintiff and the\nbystander escorted the victim off the platform through the exit gate. Intoxicated, the victim starting to accuse Plaintiff of robbing him. Plaintiff approach a Police office to explain the situation. However, seven uniformed NYPD officers had arrived on the scene, including, defendant NYPD Officers Diwan Gurung, Jorge\nDelgado-Alonzo and other unknown officers. Plaintiff was then taken into custody and searched. Plaintiff was handcuffed by defendant NYPD officers in an extremely tight fashion whereas the victim confirmed that that was not his wallet. he was taken to the 30th Precinct and then to Central booking where he was falsely and maliciously prosecuted for robbery.\n{Plaintiff was detained for 47 days inside of squalid and unventilated New York CityDepartment of Correction Facilities, which were utterly lacking in proper protections and protocols to prevent the spread of Covid-19.
