Plaintiff, a professional tow-truck driver, received a call to tow a car. Plaintiff took the car to the incident address. At the address, the owner of the vehicle refused payment for the tow. Plaintiff called the police. Defendants Keegan, Pena and Rodriguez arrived at the scene. Plaintiff provided the officers his license upon request. Plaintiff had meanwhile contacted the City’s Directed Accident Response Program for guidance. DARP informed plaintiff a sergeant was being sent to the scene. Plaintiff relayed this information to the NYPD officer defendants. Officers, angered that a sergeant had been called to the scene, arrested plaintiff. Plaintiff was eventually taken to the precinct. At the precinct, officers falsely informed the Queens County DA they observed plaintiff commit Obstruction of Governmental Administration and Disorderly Conduct. Plaintiff was subsequently taken to Queens Central Booking. Plaintiff was arraigned in Queens County Criminal Court.
