These officers include Joseph Hayward, William Schumacher, Jose Alvarez, Mckiver, and others. They attempted to lure Plaintiffs to open the door so that they could conduct a warrantless search by forcing a third party knock on Plaintiffs' door, asking for Plaintiffs' mother. Once refused entry, the officers began to bang and pound loudly on the door, causing the mother and the infants distress. The officers then informed the mother that they would call the emergency medical services to enter into the premises so that she could obtain medical care, when she did not require medical care. The ESU, including officers Robert Patelli, Sean Patterson, Robert Aasheim, Szachacz, and Schierenbeck, arrived and ripped the door off its hinges. Upon gaining entry, the officers assaulted, battered and arrested Plaintiffs. They unlawfully searched the premises and damaged and/or destroyed personal property contained within. Nothing unlawful or illegal was found in the premises or upon Plaintiffs. Prior to subject incident, defendant officers Schumacher, Hayward and others accosted a non-party, Williams for trespassing, within the building. Officers took Williams to the front door of the subject premises, and asked her to knock on the door so they could forcibly gain entry into the apartment to conduct an illegal and warrantless search. Plaintiff was woken up by one of her sons and found police on the outside of her door. She would not open the door without a warrant which the officers did not have. Officers pounded on the door and upset the plaintiff's grandkids. Officers said they would gain entry by having EMS respond to a false request for medical emergency. EMS arrived and with the officers attempted to gain entry. Plaintiff was on the phone with the Civilian Complaint Review Board. EMS and the officers gained entry into the apartment and assaulted plaintiff and sons and ordered plaintiff out into the hallway. Plaintiff was brought out to an ambulance and as she was having an anxiety attack, then taken to Brookdale Hospital. Officers searched plaintiff's premises, damaging her belongings, and found nothing illegal. Returning from the hospital, plaintiff was denied entry into her apartment, as she was told it was under \"investigation\". Plaintiff remained outside her apartment until officers allowed her back in later that morning.
