Plaintiff's mother had called him after a gunshot was reported at her apartment. When Plaintiff arrived, he observed his brother lying on the floor bleeding from the head and a gun lying next to his body. Defendant police officers arrived at the apartment, unlawfully searching Plaintiff. Defendant police officers knew Plaintiff did not live at the apartment and knew the gun did not belong to Plaintiff. Defendant police offers did not recover any drugs, contraband, or illegal paraphernalia from Plaintiff and at no time did Plaintiff commit any crime or violate the law. Nonetheless, Defendant police officers falsely arrested and imprisoned Plaintiff without probable cause or legal justification. Instead of allowing Plaintiff to accompany his dying brother to the hospital, he was transported to the 30th precinct. Defendant police officers then provided false information and evidence to the DA. Defendant Carlstrom signed a Criminal Court Complaint that contained false and misleading allegations against Plaintiff. As a result of his unlawful arrest and incarceration, Plaintiff missed his brother's funeral.
