The officers asked for identification and ordered Plaintiff out of the vehicle. Without legal justification, they searched his persons. They ordered him back into his vehicle, then returned and ordered him out for a second time, this time arresting him and handcuffing him tightly behind his back. Plaintiff was transported to a precinct where he was searched, confined in a cell, and charged with Criminal Possession of a Weapon, Criminal Possession of Marijuana, Unlawful Possession of Marijuana, Driving by Unlicensed Operator, and Violating a Red Traffic Signal Light. Officers Sabella and Sloan filed a false police report alleging that they observed Plaintiff make a turn at a steady red light, that they smelled a strong odor of marijuana emanating from Plaintiff's vehicle, that they recovered a gravity knife from Plaintiff, that they recovered a burnt marijuana cigarette from the front passenger floor of Plaintiff's vehicle, that they observed and recovered a bag containing marijuana from the rear passenger seat of Plaintiff's vehicle, and that Plaintiff was unable to produce a valid license. All of these allegations were untrue. Plaintiff spent approximately 24 hours in custody and made multiple court appearances before all charges against him were dismissed on or about April 28, 2020. \n\nOn or about July 1, 2019, at approximately 10:30 p.m. in the County of Queens, City, and State of New York, Plaintiff Howell was a passenger in a vehicle, which was lawfully parked in the vicinity of 119th Road between 153rd Street and Sutphin Blvd. NYPD Officers Brendan Langenfeld, Daniel Leboff, and other unnamed officers approached the vehicle, ordering the occupants out. When Plaintiff complied, he was handcuffed tightly, searched, and placed into a police vehicle without any legal justification. Plaintiff was transported to a police precinct and charged with Obstructing Governmental Administration and Unlawful Possession of Marijuana. Officers Langenfeld and Leboff filed a false police report alleging they smelled an odor of marijuana emanating from the vehicle, observed plaintiff with an unlit marijuana cigarette, and refused to provide identification upon request.
