Three white individuals leapt from the vehicle without identifying themselves, guns drawn, and with no badges visible. Defendant officer Ian Rule yelled at Plaintiff to raise his hands, which Plaintiff then did. Defendant officer Joseph Tennariello emerged from the driver's seat of the vehicle, immediately sprinting towards Plaintiff and tackling him into a wall. Defendant Tennariello told Plainitff he was under arrest, and when Plaintiff asked why, Tennariello told him to \"shut the fuck up\" and punched him in the head. Plaintiff, fearing for his life, started screaming for help, at which point Officer Sikorski joined Tennariello in assaulting Plaintiff by punching Plaintiff in head, face, and torso. Another officer came up behind PLaintiff and lifted Plaintiffs legs, slamming Plainitff to the pavement face first. Backup officers arrived who also joined in beating Plaintiff by stomping, kicking and punching him, and Defendant officer Becerra tased him in the back repeatedly. Defendant Rule performed a pain inducing compliance technique by rolling his baton up and down Plaintiffs Achilles Tendon. Plaintiff was eventually detained at the precinct and at a hospital for many hours before finally being released. On or about March 20, 2016, Defendant drafted and signed a felony complaint against Plaintiff without probable cause and falsely stated there was a known complainant. On or about March 25, 2017, Defendant Sikorski drafted and signed a misdemeanor complaint that also contained falsehoods and was made without probable cause. All officers testified falsely at plaintiffs trial (Tennariello testified he indentified himself as a police officer and conducted a conversation with PLainitffs, Sikorski testifed he shouted \"police\" before he engaged with Plaintiff, Becerra testified against Plaintiff and was misleading about the effects of use of his taser and falsely alleged Plaintiff resisted arrest). Plainitff was utlimately convicted and sentenced to 5 years of imprisonment and was ultimately released after 3 and 1/2 years on December 16, 2020.
