While Plaintiff was seated in the vehicle with the engine off, POs Olha Lisniak, John Doe, and Jane Doe 1-2 approached and asked Plaintiff what he was doing. Plaintiff told them he had just parked and was going to walk to his parents' house. An officer yelled at Plaintiff to get out of the car. Plaintiff asked why and officers opened the car door and pulled him from the vehicle. POs asked if Plaintiff had any alcohol, and Plaintiff told them he had not. Plaintiff was then handcuffed, searched, and brought to the 78th Precinct where POs requested Plaintiff to submit to a Breathalyzer test. Plaintiff declined and told POs they had no reason to arrest him. Plaintiff was detained until the following day, at which time he was transported to the 70th Precinct then Central Booking. POs falsely stated to prosecutors they observed Plaintiff operating a motor vehicle under the influence of alcohol, and Plaintiff was maliciously prosecuted on these charges until Plaintiff was acquitted after trial on February 8, 2017. Due to the arrest Plaintiff's car was impounded and his driver's license was suspended.
