Plaintiff overheard the individual tell P.O.s Duncan and others that he wanted a cell by himself or else “there would be trouble,” and identify himself as part of the gang “SMM.” With knowledge of potential harm that could be caused to Plaintiff, P.O.s placed the individual who was not handcuffed or restrained, in a jail cell with Plaintiff. As a result, the individual assaulted Plaintiff immediately upon entering the cell. Plaintiff was punched in his face and shoulders, sustaining significant injuries to his face, neck, head and shoulders. Plaintiff was taken to the hospital where he underwent x-rays and CAT scans and was treated for contusions to his face and forehead.
