At the light, officers Acierno and Assaidi pulled up behind plaintiff and turned their lights and siren on. Plaintiff immediately pulled over to the curb. Officers then approached and asked for his license. Plaintiff asked if he had run a red light and Acierno told him he was stopped because he was wearing a bandana that covered the lower half of his face and because his music was too loud. The covering on his face was used during work while putting down asphalt. \nPlaintiff gave his license and officers returned and told him there was a warrant for his arrest. Plaintiff exited his vehicle and told officers he had appeared in court three days prior and the prosecution had been dismissed. Officer Acierno still grabbed his arm, twisted it and tightly handcuffed plaintiff.
