Other officers arrived, used their asp on him, and dragged him along the road. NY. A crossing-guard, Simpson, within a group of people, started harassing plaintiff and his wife. Plaintiff and wife turned onto Rochester Ave. Defendant Cummings and one of the Doe defendants arrived on scene, on duty, and in an NYPD vehicle with Ms. Simpson in the backseat of the car. It was believed Cummings and Simpson were in a relationship at the time. Cummings stopped, exited his vehicle with his gun drawn, and approached plaintiff. Defendants detained and arrested plaintiff. Plaintiff was searched and tightly handcuffed, then taken to the 71st precinct. Defendants refused to call plaintiff's lawyer and forced plaintiffs wife to leave the precinct. Despite explaining to Defendant Officer Kevin Haniff that he had paperwork showing this was being repaired, Defendant Haniff ticketed Plaintiff for it and tossed the various documents toward Plaintiff’s car.  When Plaintiff got out to retrieve them and commented on Haniff's rude behavior, Defendant Haniff jumped out of his car, causing it to lurch forward and strike the Plaintiff’s car.  Defendant Haniff then began assaulting Plaintiff, joined by Defendant Officer Joel Cummings who knocked Plaintiff to the ground, and then by Defendant Officer Delissa Brown, who maced Plaintiff.  Plaintiff was treated for his injuries at the 71st Precinct.
