On April 7, 2011, the Plaintiff received clarification from the Clerk of the Bronx Criminal Court confirming that the warrant was not valid and had been deleted, and the clerk issued the Plaintiff a letter instructing NYPD officers not to arrest her on the basis of the warrant. Nevertheless, the arrests did not stop. On January 28, 2012, Officer Kerry Badala and other offices responded to a noise complaint from a party the Plaintiff was hosting and arrested the Plaintiff based on an invalid warrant entry in the NYPD warrant database. Ms. Barnes did not check the court’s database as required by NYPD policy prior to arresting the Plaintiff. On March 2, 2013, Officer Ralph George arrested and/or detained the Plaintiff based on an invalid warrant entry and failed to confirm the warrant’s validity in the court’s database. On June 11, 2013, Officer Wilfredo Velez arrested and/or detained the Plaintiff based on the inaccurate warrant entry and failed to check the court’s database before the arrest. On May 4 and 9, 2014 and March 22, 2015, the Plaintiff was arrested by unnamed defendant officers after going to the 40th Precinct to pick up her daughter based on an inaccurate warrant entry. The officers failed to verify the accuracy of the entry. On June 14, 2014, Officer Williams Diaz and others arrested the Plaintiff after giving her and her sister a summons for an open container violation because they ran her name through the system and received the inaccurate open warrant entry and failed to verify that it was correct. Plaintiff informed the officers that it was an inaccurate entry, but they nonetheless arrested her and placed handcuffs on tightly in a manner that strained her recently dislocated shoulder. \n\nDefendant Officers Diaz and unnamed officers knew on June 14 and 15, 2014 while Ms. Barnes was in NYPD custody in the 40th Precinct that the Plaintiff was experiencing severe shoulder pain, chest pain, shortness of breath, and psychological distress for hours, and each of them ignored her requests for medical attention. In distress, on June 15, the Plaintiff hanged herself in the holding cell. Officers who intervened to save her life, their supervisors, and internal affairs officers confirmed that the Plaintiff was unlawfully arrested on an invalid warrant. On or around June 15, 2014, Sergeant FNU Lau, Captain Anthony Piazza, Officer FNU Stevens, Officer Oneil Smith, Sergeant Yoshira Rosario, Michael Soto, and Francisco Diodonet learned that the warrant entry for the Plaintiff was invalid. However, they did nothing to correct the database. On August 4, 2014, officers arrested the Plaintiff again based on an inaccurate warrant entry after giving her a summons (which was later dismissed) for a marijuana violation because she was sitting next to coworkers who were smoking marijuana. Unnamed defendant officers were also involved in arresting or detaining the Plaintiff based on an inaccurate warrant entry on March 2, 2013, June 11, 2013, October 8, 2013, December 16, 2014, and other dates between November 25, 2012 through August 31, 2015. Detective John Sabino’s duty is to administer the NYPD warrant database and correct errors, yet the error in Plaintiff’s invalid warrant entry was not remedied.
