When PREKAS stood up out of his bed, a defendant officer pressed his firearm against Prekas’ chest and a defendant officer, believed to be Robert Patelli, handcuffed Prekas without cause. Defendants Matthew Edelman, Donald Stewart, Luis Torino, William Russo, Kevin Sills, Matthew Bilotti, Michael Zak, and Dennis Maira, entered the location and searched both the first floor and Prekas’ apartment. These officers include Joseph Hayward, William Schumacher, Jose Alvarez, Mckiver, and others. They attempted to lure Plaintiffs to open the door so that they could conduct a warrantless search by forcing a third party knock on Plaintiffs' door, asking for Plaintiffs' mother. Once refused entry, the officers began to bang and pound loudly on the door, causing the mother and the infants distress. The officers then informed the mother that they would call the emergency medical services to enter into the premises so that she could obtain medical care, when she did not require medical care. The ESU, including officers Robert Patelli, Sean Patterson, Robert Aasheim, Szachacz, and Schierenbeck, arrived and ripped the door off its hinges. Upon gaining entry, the officers assaulted, battered and arrested Plaintiffs. They unlawfully searched the premises and damaged and/or destroyed personal property contained within. Nothing unlawful or illegal was found in the premises or upon Plaintiffs.
